The conflict between the world’s famous Apple and Masimo took a new turn. A law enforcement agency based in the US has given Apple a green signal to redesign its watches to avoid the ban on imports of the new models. The ban was imposed on Apple as a result of a dispute between Apple and Masimo (a medical technology company).
What Was Apple Accused Of?
Masimo accused that Apple hired its employees and used them to steal the information regarding Masimo’s oximetry technology and used the stolen information in new Apple watches. In return, Apple countersued Masimo for patent infringement.
The ban issued by the ITC was applied to series nine and Ultra 2 watches of Apple from December 26. Apple somehow managed to stop the ban temporarily and continued selling its watches.
Redesigning Of the Watches:
Apple claimed that by redesigning its watches, Masimo’s concerns related to blood-oxygen reading technology will be solved. In the recent court hearing, Masimo stated that Apple had informed US Customs that the redesigned watches do not have the function of oximetry technology. However, other details of the redesign were not disclosed.
Apple stopped selling its watches in the United States, but it resumed the selling process shortly again after the high court known as the Federal Circuit stopped the ban. The reason to stop the ban was to give a second thought to Apple’s appeal. However, the process of the appeal and ban will take about a year to finish. While Apple eagerly waits for the decision and wants it as soon as possible.
Apple and Masimo both have thought and talked about how it would be good or bad to keep or lift the ban. They both have different perspectives regarding the ban. Apple believes that it will probably win the appeal, and the ban would hurt the company, suppliers, and the common public as well. On the other hand, Masimo Tech believes that the pause will negatively affect the business, its reputation, its scientists, and its engineers.
